PLAE SPORT AND PLAE EDUCATION PROGRAM TERMS AND CONDITIONS

These Program Terms and Conditions apply to registrations with PLAE Sport and PLAE Education, collectively referred to throughout these terms as PLAE.

By completing a registration, the parent or legal guardian confirms that they have authority to register the participant and agrees to these terms on behalf of themselves and the participant.

Registration and Enrolment

Registration is for the specific program, class, camp, clinic, event, or session selected during registration.

A registration is considered confirmed once it has been accepted by PLAE and any required payment has been successfully processed.

Families are responsible for providing accurate and current participant, contact, emergency, medical, allergy, and authorized pickup information.

Participants must meet the age or other eligibility requirements identified for the program.

PLAE may make reasonable adjustments to coaching assignments, facility spaces, program groupings, program activities, or program delivery when necessary to safely and effectively operate a program.

Fees and Payment

Program fees are displayed during registration and are due according to the payment terms shown at checkout.

By providing a payment method, the account holder authorizes PLAE and its registration or payment provider to process the applicable registration fees, instalments, taxes, and other disclosed charges.

Families are responsible for ensuring that payment information remains current.

An outstanding balance may result in suspension of registration or participation until the account is resolved.

Families who believe a charge has been made incorrectly should contact PLAE so that the matter can be reviewed.

Withdrawal and Refund Policy

Withdrawal requests must be received at least three weeks before the program start date to qualify for a refund.

Eligible refunds are subject to a five percent processing fee to offset payment processing and administrative costs.

Credit Card Processing Fees

For approved refunds requested by families who paid by credit card, the original credit card processing fees are non-refundable. Refunds will include eligible program registration fees only, in accordance with PLAE Sport's withdrawal and refund policy.

If a withdrawal request is received less than three weeks before the program start date, no refund will be issued.

Where possible, PLAE may allow the family to transfer the participant to another available class or location within the same season or transfer the registration to another child within the same family.

Transfers are subject to availability and approval and are not guaranteed.

Promotional codes and discounts must be applied at the time of registration and cannot be applied retroactively after registration has been completed.

If a family chooses to cancel an eligible registration in order to register again using a promotional code or discount, the original registration will be treated as a standard withdrawal and any applicable processing fee will apply.

If a participant becomes unable to participate because of a significant injury or illness, PLAE may provide a prorated refund or account credit after receiving appropriate medical documentation confirming that participation in physical activity is not recommended.

Any exception to the standard withdrawal and refund policy is at the discretion of PLAE.

Program Cancellations and Schedule Changes

PLAE reserves the right to cancel, postpone, relocate, or adjust a program because of insufficient enrolment, facility availability, staffing, weather, safety concerns, school closures, or other circumstances affecting program delivery.

When a planned material change is known and reasonably within PLAE's control, PLAE will communicate the change to registered families at least seven calendar days before the scheduled program start date.

Whenever possible, PLAE will communicate significant program changes earlier than seven days before the program begins.

Material changes may include:

A change to the program location.
A significant change to the scheduled class time.
A change to the program start date or scheduled program dates.
A significant change that materially affects where or when the registered program will operate.

Communication regarding these changes will normally be sent by email to the primary email address associated with the family's registration account.

Families are responsible for ensuring that their email address is accurate and current and for reviewing emails from PLAE leading up to and throughout the registered program.

Failure to review an email notification does not remove the family's responsibility to follow an updated program schedule, location, or other communicated program information.

PLAE operates many programs in schools, community facilities, recreation spaces, and other third party locations. Occasionally, a school, school district, municipality, facility operator, or other location partner may close a facility, cancel access, change availability, or otherwise affect PLAE's ability to operate a scheduled program.

These circumstances may occur with less than seven days notice and may be outside PLAE's control.

When an unexpected facility or schedule change occurs, PLAE will respond based on the circumstances and will communicate the change to registered families as soon as reasonably possible.

Depending on the circumstances, PLAE may relocate the program, adjust the schedule, change a program date, postpone a class, cancel a class, or provide another reasonable alternative.

If PLAE cancels an entire program before it begins and cannot provide a suitable alternative, the registration fee for that program will be refunded in full.

If PLAE makes a planned significant change to the scheduled class time of more than sixty minutes, families will be given the option to transfer to another available program or receive an account credit for a future PLAE program.

Individual classes may occasionally be cancelled because of weather, school or facility closures, unsafe conditions, coach availability, or other circumstances outside the normal operation of the program.

When an individual class is cancelled, PLAE will determine the most appropriate response based on the circumstances, program structure, facility availability, and remaining program schedule.

This may include rescheduling the class, adjusting the program schedule, offering an alternative participation opportunity, or providing another reasonable solution.

Participant Absences

Program fees reserve a participant's space for the duration of the registered program.

Refunds or credits are not provided for individual classes missed because of personal schedules, vacations, illness, transportation issues, or other participant absences.

Where PLAE is able to provide an alternative participation opportunity, it will be subject to available space, program compatibility, and approval by PLAE.

Alternative participation opportunities are not guaranteed.

Transfers

Transfers may be approved within the same season when suitable space is available.

A transfer is not guaranteed and may be limited by program type, age group, location, facility, capacity, schedule, or other operational requirements.

Some programs may not be transferable between different program types or seasons.

Any difference in program fees resulting from an approved transfer may be charged or credited to the family's account as appropriate.

Waitlists

When a program is full, families may join the waitlist where available.

Joining a waitlist does not guarantee future registration.

If a space becomes available, PLAE will contact eligible families according to the registration process being used for that program.

Registration is not confirmed until the available space has been accepted and the registration process has been completed.

When registration occurs after a program has started, fees may be prorated where applicable.

Safe and Positive Community

PLAE is committed to providing a safe, welcoming, respectful, inclusive, and positive environment for participants, families, coaches, staff, and facility partners.

Participants and accompanying adults are expected to behave respectfully and to follow reasonable instructions provided by PLAE coaches and staff.

Behaviour that negatively affects the safety, wellbeing, learning, participation, or enjoyment of others may result in intervention by PLAE.

Depending on the circumstances, PLAE may:

Communicate the concern to the participant and family.
Document the behaviour or incident.
Request a meeting with the participant and parent or legal guardian.
Temporarily suspend the participant from programming while concerns are addressed.
Establish expectations or conditions for continued participation.
Remove the participant from the program.

PLAE will normally work progressively with families to address concerns.

However, PLAE may move directly to suspension or removal when behaviour presents a significant safety concern, involves serious misconduct, or when PLAE determines that immediate action is reasonably necessary to protect participants, staff, or the program environment.

If PLAE removes a participant from a program because of a serious or repeated violation of the Safe and Positive Community Policy, a refund will not be issued unless otherwise determined by PLAE.

Arrival and Dismissal

Children must not be left unattended before the scheduled start of a program.

Parents and caregivers are responsible for ensuring that participants are delivered to the appropriate program area and are appropriately received by PLAE staff before leaving.

Participants must be picked up promptly when the program ends.

PLAE does not provide extended supervision after the scheduled conclusion of a class unless that service is specifically included in the registered program.

Families must identify any person who is authorized to pick up their child.

PLAE may refuse to release a participant to an individual when staff cannot reasonably confirm that the individual is authorized to pick up the participant.

Parents and caregivers are responsible for keeping authorized pickup information current.

Parent and Caregiver Supervision

Some PLAE programs require a parent or caregiver to participate with the child or remain onsite for the duration of the program.

Families are responsible for reviewing and following the supervision requirements identified for their specific program.

In parent participation programs, the accompanying adult is expected to actively support the child and follow reasonable directions from the coach.

PLAE may also request that a parent or caregiver remain onsite when additional support may reasonably be required for a participant.

Health, Allergies and Additional Support Needs

Families are responsible for providing accurate information about medical conditions, allergies, medications, injuries, accessibility requirements, behavioural considerations, or other information that may reasonably affect safe and successful participation.

Families must notify PLAE if relevant information changes during the program.

PLAE welcomes conversations about additional support needs so that reasonable strategies can be considered before or during participation.

Where caregiver support is required, PLAE will work with the family to determine an appropriate approach to participation.

Where emergency medication or specific medical support may be required, families are responsible for providing the required medication, instructions, permissions, and relevant information.

PLAE cannot guarantee that program environments will be completely free from allergens.

Families with concerns regarding significant allergies or medical needs should communicate with PLAE before the participant attends their first class.

Illness

Participants should not attend programming when they are experiencing an illness that may significantly affect their ability to participate safely or that may reasonably place other participants or staff at risk.

PLAE may ask a participant to stop participating or be picked up when staff determine that the participant is not well enough to continue safely.

Families are responsible for arranging prompt pickup when requested.

Clothing, Footwear and Equipment

Participants are responsible for arriving with appropriate clothing, footwear, water, equipment, medication, and other items identified in the program description or registration communication.

Indoor programs may require clean, non marking indoor footwear.

Program specific equipment requirements may vary depending on the activity and facility.

Families should label personal belongings whenever practical.

PLAE is not responsible for ordinary loss, theft, or damage to personal belongings brought to a program.

Food and Allergies

Food may be restricted during regular PLAE classes because of participant allergies and facility requirements.

When food is permitted or required, including during certain camps, events, or extended programs, families must follow the food requirements communicated for that program.

Where requested, food must be nut free.

Participants should not share food or drinks with other participants.

Families remain responsible for informing PLAE of all known allergies and providing any required emergency medication.

Photography, Video and Participant Privacy

PLAE may collect and use personal information as reasonably necessary to administer registrations, communicate with families, support participant safety, process payments, manage programs, and meet legal or operational requirements.

Additional information about the collection, use, protection, storage, and retention of personal information may be provided through the PLAE Privacy Policy.

Permission for PLAE to use a participant's photograph, video, or likeness for promotional, marketing, website, social media, publication, or similar purposes will be requested separately from these Program Terms and Conditions.

Parents, caregivers, and spectators may photograph their own child where facility and program rules allow.

Families should avoid intentionally photographing or recording other participants without permission.

Video recording or photography may be restricted by PLAE or by the host facility.

Facility Rules

PLAE programs operate in schools, community centres, recreation facilities, outdoor spaces, private facilities, and other partner locations.

Participants, parents, caregivers, and spectators are required to follow the reasonable rules of each host facility in addition to PLAE policies.

Access to hallways, classrooms, equipment rooms, stages, change rooms, fields, courts, or other areas may be restricted depending on the facility.

Failure to follow facility rules may affect continued participation.

Program Delivery

PLAE programs are designed to support age appropriate physical activity, skill development, confidence, learning, social interaction, and enjoyment.

Program activities may be adjusted based on participant needs, class dynamics, facility limitations, equipment availability, safety considerations, or coach judgement.

PLAE does not guarantee that every participant will progress at the same rate or achieve a particular skill outcome during a program.

Coaches may modify activities to help participants participate safely and successfully.

Communications

Email, the PLAE registration platform, and other communication channels identified by PLAE are considered official methods of program communication.

Email will be the primary method used to communicate significant changes to program dates, times, locations, cancellations, and other important program information.

Families are responsible for maintaining a current email address and reviewing PLAE communications before and throughout their registered program.

Families are also encouraged to check junk or spam folders if expected PLAE communications are not appearing in their primary inbox.

Formal withdrawal requests must be submitted through an official PLAE communication channel.

Social media comments or direct messages are not considered formal withdrawal requests.

Changes to Policies

PLAE may update operational policies when necessary to improve safety, service, program delivery, or administration.

Material changes affecting an active registration will be communicated to families where reasonably required.

The financial terms in effect at the time of registration will generally govern that registration unless the family and PLAE agree otherwise or a change is required by law.

Governing Law

These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable in New Brunswick.

If any portion of these terms is found to be invalid or unenforceable, the remaining portions will continue to apply to the extent permitted by law.
