Carry On Skateboard Program Release of Liability, Assumption of Risk, and Indemnity Agreement (Scroll down to see terms of agreement.)

The mission of the Carry On Foundation is to help youth develop confidence, competence, connection, and character. Participants in the Carry On Skateboard Program (the "Program") will receive coaching in skateboarding and participate in skateboarding and skateboarding training activities. The Carry On Foundation makes no guarantees of specific results, success, or achievement from or through the Program. Those with symptoms of physical or mental illness should consult a licensed medical professional before participating in Program activities.

I, AS A PARTICIPANT OR AS THE PARENT OR GUARDIAN OF A MINOR PARTICIPANT IN THE PROGRAM AND/OR USER OF THE CARRY ON FOUNDATION'S SKATEBOARD FACILITIES AT 244 W 100 S PROVO, 6277 CRIMSON VIEW DR IN SOUTH JORDAN, THREAD WALLETS HEADQUARTERS IN PROVO, OR OTHER PRIVATE OR PUBLIC PARKS OR FACILITIES (COLLECTIVELY, THE "FACILITIES"), ASSUME ALL ASSOCIATED RISKS (PHYSICAL, MENTAL, AND EMOTIONAL). I FURTHER AGREE AS FOLLOWS:

1. Understanding and Assumption of Risk: Skateboarding is an action sport involving significant risk. I understand and assume the risks associated with skateboarding and related training and activities, including without limitation the following: The facilities used for skateboarding and skateboarding training include potentially dangerous props and obstacles like rails, stairs, ramps, banks, half-pipes, quarter-pipes, bowls, pools, boxes and ledges that are designed for stunts and extreme maneuvers. Risks include, but are not limited to, hard, slick, uneven, abrasive, banked, curved, and sloped surfaces, hard and sharp edges, elevated platforms, collisions between participants, equipment failure, and frequent falls and impacts. Possible injuries include, but are not limited to, scrapes, abrasions, contusions, sprains, strains, dislocations, broken bones, concussions, head trauma, and in extreme cases paralysis or death. I agree to follow, and to require my child to follow, any safety or other rules required for participation in the Program and/or use of the Facilities, but I understand that no rules can eliminate the risks described herein.

2. Release: I acknowledge that participation in the Program and its related activities and/or use of the Facilities, including but not limited to skateboarding and skateboarding training, may involve bodily injury and/or emotional injury to my child and/or myself. In consideration of me or my child being able to participate in such activities, I for myself, my child, my heirs, my executors and administrators, hereby voluntarily and knowingly indemnify, hold harmless, defend, release, waive, and discharge the Carry On, Ramp Carnies LLC, Dream Ramps LLC, and Thread Wallets LLC, and each of their respective owners, officers, directors, employees, landlords, members, affiliates, subsidiaries, agents, and independent contractors, from any and al suits, proceedings, claims, damages, injuries, costs, and any other losses and liabilities of any kind whatsoever (collectively, "losses"), that may result from my or my child's participation in the Program or use of the Facilities, including without limitation any losses resulting from negligence or willful misconduct. I further agree that I or my insurance company will pay for any medical, hospitalization, or other expenses resulting from my or my child's participation, and I understand that the Carry On Foundation, Ramp Carnies, Dream Ramps, Thread Wallets, and their building owners and landlords do not provide insurance to cover injuries incurred while participating in Program events or using the Facilities.

3. Emergency Treatment: I hereby authorize officers, employees, volunteers, and agents of the Facilities and/or the Program to act on my behalf in accordance with their own judgment in case of an emergency involving me or my child, and I consent to any medical or other treatment deemed advisable in the event of any injury, accident, or illness. I further agree to assume full responsibility for all expenses, medical or otherwise, that may arise therefrom.

4. Photo Release: I agree to be photographed and/or recorded and to have my child photographed and/or recorded while participating in or attending Program activities or events or using the Facilities, and I release the use of any photograph, video, audio, film, or other likeness for publicity or any other legitimate purpose for or by the Facilities, the Program, or the Carry On Foundation.

5. Waiver: This waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. This agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Utah. The state and federal courts located in Salt Lake County, Utah will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with this agreement.
